Commission Terms of Service

These terms cover all commissions requested through the form at colefekert.com: pen illustration, digital painting, graphic art, photography, and written pieces. Submitting a request means you agree to the terms below.

1. How It Works

Submitting the form reserves a ticket, it does not confirm the commission. I review requests in the order they arrive and reply as soon as I’m able with next steps. A commission is only confirmed once we’ve discussed the commission in more detail over email, and both confirmed that we’re amenable to whatever terms.

2. Pricing & Payment

• The budget range you select on the form is a starting point for discussion, not a final price. Final pricing depends on complexity, size, and revisions, and will always be confirmed with you before any work begins.
• A non-refundable deposit is required before work starts. The deposit secures your place in the queue and covers time already spent on sketches/drafts. (Despite this, the amount is totally up for discussion.)
• The remaining balance is due upon completion, before final files are delivered.
• Accepted payment methods: PayPal / Venmo / Mailed Cash or Check.
• Prices do not include tax where applicable; you’re responsible for any taxes owed on your end.

3. Revisions

• Each commission includes 2 rounds of minor revisions (color, small adjustments, tweaks to a sketch) at no extra cost.
• Major changes after a stage has been approved (e.g., requesting a full pose change after the sketch is approved, or a new concept after painting has started) may incur an additional fee, quoted before I proceed.
• Once a piece is marked final and delivered, further changes are billed as a new, smaller commission.

4. Timeline & Delivery

• Turnaround time varies by piece and current queue length, and will be estimated in your quote. It is an estimate, not a guarantee.
• I’ll keep you updated on major milestones (sketch, color pass, final) so you can catch anything early.
• If I’m going to be significantly delayed, I’ll tell you rather than let a deadline pass silently.
• Final files are delivered digitally [via email / a download link — fill in]. Physical prints, if offered, are a separate add-on.

5. Usage Rights

The Usage option you select on the request form determines what you’re licensed to do with the finished piece:

• Personal only — You may use the piece for personal, non-commercial purposes (profile pictures, personal prints, wallpapers, etc.). You may not resell it, use it commercially, or claim you created it.
• Prints & merch — Personal use, plus the right to produce and sell a small, limited run of physical prints or merchandise featuring the piece, for your own account/store. [Set any limits here, e.g. “up to 100 units” — fill in].
• Commercial / branding — Use in logos, branding, advertising, or other commercial contexts beyond small-batch merch. This tier may carry an additional licensing fee, quoted separately based on intended use.

In every case, I (Cole Fekert) retain full copyright and ownership of the artwork itself. You’re purchasing a license to use the piece under the terms above, not the underlying rights. I reserve the right to display finished commissions in my portfolio, on social media, and in my store, unless you request privacy and we agree to it in writing before work begins.

Commissioned work may not be used to train AI/ML models, minted as an NFT, or used in any way not covered by your selected usage tier, without separate written permission.

6. Content Guidelines

I’m happy to discuss most subjects, but I will decline or stop work on requests involving:

• Hate symbols, hateful imagery.
• Content involving minors in a sexual or exploitative context, under any framing.
• Direct, uncredited copies of another artist’s work.

If a request is declined for content reasons, any deposit already paid will be refunded in full.

7. Cancellations & Refunds

• Before work begins: full refund of any payment made.
• After work begins, before the sketch stage is approved: deposit is non-refundable; any amount paid beyond the deposit is refunded.
• After the sketch stage is approved: no refunds, as time and materials have already gone into the piece. You’ll still receive the work completed to that point.
• If I need to cancel a commission for any reason, you’ll receive a full refund for any work not yet delivered.

8. Communication

• Primary contact is the email you provide on the request form; Discord is a good secondary if email is slow.
• Please keep replies reasonably prompt during an active commission, long silences on approvals can slow down the whole process. That said, I’ll do my best to respond promptly as well. Let’s work together well here!

9. Changes to These Terms

These terms may be updated from time to time; the version in effect at the time you submit your request is the one that applies to that commission.
